Writ of Certiorari denied – Cosmos Jewelry Ltd. Prevails in Trade Dress Infringement Case

The U.S. Supreme Court denied the Petition for Writ of Certiorari filed by Alan Hon and Po Sun Hon following the Ninth Circuit’s denial of their appeal in the Cosmos Jewelry Ltd. Trade Dress Infringement case.

Cosmos Jewelry Ltd., represented by Rod Berman and Stanley Gibson, prevailed in a trial in the U.S. District Court for the Central District of California against Los Angeles-based jeweler Alan Hon and his company, for making and selling copies of Cosmos’ unique line of jewelry. Gibson tried the case and won a judgment of $2.3 million in damages, a permanent injunction and an award of attorneys’ fees. Hon and Po Sun Hon appealed the case claiming the District Court Judge erred in finding trade dress infringement and awarding damages and attorneys’ fees.
